Public Procurement Policy for Micro and Small Enterprises (MSEs) Order 2012- Amendment Notification

S.O. 3237(E).—In exercise of the powers conferred by section 11 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), the Central Government hereby makes the following order further to amend the Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012, namely:-

1. Short title and commencement.-
   (1) This order may be called the Public Procurement Policy for Micro and Small Enterprises (MSEs) Amendment Order, 2021.
   (2) This order shall come into force on the date of its publication in the Official Gazette.
   
2. In the Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012, (hereinafter referred to as the said order), in paragraph 3, sub-paragraph (1) shall be omitted.
   
3. In the said order, paragraph 7, the following paragraph shall be substituted, namely:-
   
   “7. Developing Micro and Small Enterprises vendors.- The Central Ministries or Departments or Public Sector Undertakings shall take necessary steps to develop appropriate vendors by organising Vendor Development Programmes or Buyer-Seller Meets focused on developing Micro and Small Enterprises (MSEs) for procurement through GeM Portal.”.
   
4. In the said order, paragraph 8 shall be omitted.
   
5. In the said order, for paragraph 2 of the Annexure, the following paragraph shall be substituted, namely:-
   
   “2. The composition of the Committee shall be as follows, namely:-
   
   (i) Secretary, Ministry of MSME : Chairman
   
   (ii) representative of Chief Executive Officer, Niti Aayog : Member;
   (Not below the rank of Additional Secretary)
   
   (iii) Secretary, Department of Public Enterprises : Member;
   
   (iv) Chief Executive Officer, Government e-Marketplace : Member;
   Department of Commerce
   Ministry of Commerce and Industry
   
   (v) representative of Secretary, : Member;
   Department of Expenditure,
   Ministry of Finance
   (Not below the rank of Additional Secretary)
   
   (vi) representative of Secretary, : Member;
   Ministry of Defence
   (Not below the rank of Additional Secretary)
   
   (vii) representative of Chairman : Member;
   Railway Board,
   Ministry of Railways
   (Not below the rank of Additional Secretary)
   
   (viii) Additional Secretary and : Member Secretary
   Development Commissioner (MSME)
