The Aircraft (Carriage of Dangerous Goods) (Amendment) Rules, 2022

G.S.R. 112(E).—Whereas, the draft of certain rules further to amend the Aircraft (Carriage of Dangerous Goods) Rules, 2003, was published as required under section 14 of the Aircraft Act, 1934 (22 of 1934), vide notification of the Government of India in the Ministry of Civil Aviation, number G.S.R. 718 (E), dated the 30th September, 2021 in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public;

And whereas, copies of the Gazette containing the said notification were made available to the public on the 5th October, 2021;

And whereas, the objections and suggestions received from the public in respect of the draft rules within the period so specified have been taken into consideration;

Now, therefore, in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of 1934) the
Central Government hereby makes the following rules further to amend the Aircraft (Carriage of Dangerous Goods) Rules, 2003, namely: —

  1. These rules may be called the Aircraft (Carriage of Dangerous Goods) (Amendment) Rules, 2022.
  2. These shall come into force on the date of their publication in the Official Gazette.
  3. In the Aircraft (Carriage of Dangerous Goods) Rules, 2003. —

    (A) In rule 2, —
    (i) in clause (5), for the word “risk”, the word “hazard” shall be substituted;
    (ii) in clause (13), for the word “conainment”, the word “containment” shall be substituted;
    (iii) in clause (16), in sub-lause (b), for the word “fingures”, the word “fingers” shall be substituted.

    (B) In rule 9A, in sub-rule (2), in clause (ii), for the word “shipper”, the words “shipper and his agent, if any” shall be substituted.

    (C) In rule 10A, for the word “officer” wherever it occurs, the word “person” shall be substituted.

    (D) In rule 12A, for sub-rule (9), the following sub-rule shall be substituted, namey:—
    “(9) The fee shall be paid electronically in the manner as specified by the Director-General.”.

Note.─ The principal rules were published in the Gazette of India, vide notification number G.S.R. 206(E), dated the 5th March, 2003 and last amended vide G.S.R. 275(E) dated 25th February, 2016 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (i) dated the 3rd March, 2016.
