New Rules regulating the method of recruitment- Ministry of Finance, Department of Revenue, Central Board of Indirect Taxes and Customs, Commissionerates, Lower Division Clerk, Group ‘C‘ Post Recruitment Rules, 2022.
G.S.R. 18(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Finance, Department of Revenue, Central Excise and Customs (Lower Division Clerk) Recruitment Rules, 2013, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Lower Division Clerk in the Commissionerates under the control of the Central Board of Indirect Taxes and Customs, Department of Revenue, Ministry of Finance, namely:-
- Short title and commencement. –
(1) These rules may be called the Ministry of Finance, Department of Revenue, Central Board of Indirect Taxes and Customs, Commissionerates, Lower Division Clerk, Group ‘C‘ Post Recruitment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette. - Initial constitution. –
(1) Personnel holding the post of Record Keeper (Group ‘C‘ post) prior to Cadre Restructuring dated the 18th December, 2013 immediately before the commencement of these rules on regular basis shall be deemed to have been appointed in accordance with the provision of these rules.
(2) The regular continuous service of personnel referred above in the respective grade immediately before the commencement of these rules shall count for the purpose of period of probation, seniority, qualifying service for promotion, confirmation and pension in the service. - Number of post, classification and level in pay matrix. — The number of the said post, its classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
- Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.
- Special provision. –
(1) Each Cadre Controlling Authority (CCA) shall have its own separate Cadre, unless otherwise directed by the Central Board of Indirect Taxes and Customs.
(2) Notwithstanding anything contained in sub-rule#(1), the Chief Commissioner of Central Excise or Chief Commissioner of Customs having jurisdiction over the concerned Commissionerate, may, if he considers it necessary or expedient in the public interest so to do and subject to such condition as he may specify having regard to the circumstances of the case and for the reasons to be recorded in writing, order any post in the Commissionerate to be filled by absorption of persons holding the same or analogous post but belonging to the Cadre of another Commissionerate or any other office under the Central Board of Indirect Taxes and Customs, as the case may be.
(3) Sanctioned strength of National Academy of Customs, Indirect Taxes and Narcotics directorate is borne on and drawn from Cadre Controlling Authority of the respective zone. - Disqualification. — No person, —
(a) who, has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. - Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
- Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
