NFRA Amendment Rules 2022 related to the employees and Salary

G.S.R. 4(E).—In exercise of the powers conferred by sub-section (11) of section 132 of the Companies Act, 2013 (18 of 2013), the Central Government hereby makes the following rules further to amend the National Financial Reporting Authority (Recruitment, Salary, Allowances and Other Terms and Conditions of Service of Secretary, Officers and Other Employees of Authority) Rules, 2019, namely:-

1. Short title and commencement. – (1) These rules may be called the National Financial Reporting Authority (Recruitment, Salary, Allowances and Other Terms and Conditions of Service of Secretary, Officers and Other Employees of Authority), Amendment, Rules, 2022.
   (2) They shall come into force on the date of their publication in the Official Gazette.
   
2. In the National Financial Reporting Authority (Recruitment, Salary, Allowances and Other Terms and Conditions of Service of Secretary, Officers and Other Employees of Authority) Rules, 2019, –
   
   (i) for rule 3, the following rule shall be substituted, namely:-
   
   “3. Recruitment and appointment of employees.-
   (1) The number of posts, mode of recruitment, eligibility and composition of Departmental Promotion Committee for each post shall be such as specified in the Schedule.
   (2) The Central Government may, on the recommendation of the Departmental Promotion Committee, appoint the Secretary and Executive Director of the Authority.
   (3) The Authority may, on the recommendation of the Departmental Promotion Committee, appoint the Chief General Manager (CGM), General Manager (GM), Deputy General Manager (DGM), Assistant General Manager (AGM), Manager, Assistant Manager, Personal or General Assistant, Sr. PS., Private Secretary and Driver of the Authority in accordance with these rules.
   (4) The Authority shall invite applications for the posts of Chief General Manager (CGM), General Manager (GM), Deputy General Manager (DGM), Assistant General Manager (AGM), Manager, Assistant Manager, Personal or General Assistant, Sr. PS., Private Secretary and Driver of the Authority from eligible candidates after observing due process, examine suitability of their candidature and provide the list of eligible candidates to the Departmental Promotion Committee to undertake the selection process.”;
   
   (ii) In the Schedule, –
   
   (a) against serial number 1 in Column (1) relating to the post of Secretary, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Secretary (Ministry of Corporate Affairs) – Chairman
   (2) Chairperson, Authority – Member;
   (3) Joint Secretary (National Financial Reporting Authority or Ministry of Corporate Affairs) – Member.”;
   
   (b) against serial number 2 in Column (1) relating to the post of Executive Director, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Chairperson, Authority – Chairman;
   (2) Joint Secretary (National Financial Reporting Authority or Ministry of CorporateAffairs) – Member;
   (3) one external expert to be nominated by the Authority – Member.”;
   
   (c) against serial number 3 in Column (1) relating to the post of Chief General Manager (CGM), for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Chairperson, Authority – Chairman;
   (2) one Full-time Member, Authority – Member;
   (3) one external expert to be nominated by the Authority – Member.”;
   
   (d) against serial number 4 in Column (1) relating to the post of General Manager (GM), for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Chairperson, Authority – Chairman;
   (2) one Full-time Member, Authority – Member;
   (3) one external expert to be nominated by the Authority – Member.”;
   
   (e) against serial number 5 in Column (1) relating to the post of Deputy General Manager (DGM), for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Chairperson, Authority – Chairman;
   (2) one Full-time Member, Authority – Member;
   (3) one external expert to be nominated by the Authority – Member.”;
   
   (f) against serial number 6 in Column (1) relating to the post of Assistant General Manager (AGM), for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Chairperson, Authority – Chairman;
   (2) one Full-time Member, Authority – Member;
   (3) one external expert to be nominated by the Authority – Member.”;
   
   (g) against serial number 7 in Column (1) relating to the post of Manager, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Chairperson, Authority – Chairman;
   (2) one Full-time Member, Authority – Member;
   (3) one external expert to be nominated by the Authority – Member.”;
   
   (h) against serial number 8 in Column (1) relating to the post of Assistant Manager, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Chairperson, Authority – Chairman;
   (2) one Full-time Member, Authority – Member;
   (3) one external expert to be nominated by the Authority – Member.”;
   
   (i) against serial number 9 in Column (1) relating to the post of Personal or General Assistant, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Secretary, Authority – Chairman;
   (2) Executive Director, Authority – Member;
   (3) Chief General Manager (CGM), Authority – Member.”;
   
   (j) against serial number 10 in Column (1) relating to the post of Personal or General Assistant, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Secretary, Authority – Chairman;
   (2) Executive Director, Authority – Member;
   (3) Chief General Manager (CGM), Authority – Member.”;
   
   (k) against serial number 11 in Column (1) relating to the post of Personal or General Assistant, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Secretary, Authority – Chairman;
   (2) Executive Director, Authority – Member;
   (3) Chief General Manager (CGM), Authority – Member.”;
   
   (l) against serial number 12 in Column (1) relating to the post of Sr. PS, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Secretary, Authority – Chairman;
   (2) Chief General Manager (CGM), Authority – Member;
   (3) Deputy General Manager (DGM), Authority – Member.”;
   
   (m) against serial number 13 in Column (1) relating to the post of Private Secretary, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Secretary, Authority – Chairman;
   (2) Chief General Manager (CGM), Authority – Member;
   (3) Deputy General Manager (DGM), Authority – Member.”;
   
   (n) against serial number 14 in Column (1) relating to the post of Driver, for the entries in Column (12), the following entries shall be substituted, namely:-
   “(1) Secretary, Authority – Chairman;
   (2) Chief General Manager (CGM), Authority – Member;
   (3) Deputy General Manager (DGM), Authority – Member.”
