The Government has updated the Citizenship Rules, 2009 through the Citizenship (Amendment) Rules, 2026. These changes take effect from the date they were published in the Official Gazette.

Key Highlights are:

1. Minor Child Passport Rule: A minor child holding an Indian passport cannot simultaneously hold the passport of any other country.

2. OCI Applications Fully Online: Applications for registration as an Overseas Citizen of India (OCI) cardholder must now be submitted online through the official OCI portal.

3. e-OCI Introduced: OCI registration may now be issued in:

  • Physical OCI card, or
  • Electronic OCI (e-OCI)

4. Digital Record Maintenance: Authorities will maintain OCI holder records in electronic form.

5. OCI Renunciation Process Updated: If a person wishes to surrender OCI status:

  • Application must be filed online
  • Physical OCI card must be surrendered (if issued physically)
  • Digital acknowledgment will be issued

6. OCI Cancellation Rules Revised: If OCI registration is cancelled:

  • Physical card must be returned when asked
  • e-OCI can also be cancelled digitally
  • Authorities will update electronic records

7. Appeal / Revision System Improved: A person unhappy with a citizenship or OCI decision can seek revision before a higher authority.

8. Review by Central Government: A separate review application process has been introduced, to be handled by the Central Government after giving a fair hearing.

9. Biometric Consent for Fast Track Immigration: OCI applicants may consent to use their biometric data for future registration under the Fast Track Immigration Programme.
