DGFT Extends SCOMET Authorisation Facilitation to 4-Star and 5-Star Export Houses and Increases GAER Validity from 1 Year to 3 Years – Public Notice No. 36/2026-27 dated 2 November 2026
The Directorate General of Foreign Trade (DGFT), Ministry of Commerce and Industry, has issued Public Notice No. 36/2026-27, introducing amendments to Chapter 10 of the Handbook of Procedures (HBP), 2023.
The amendments aim to simplify export-related compliance requirements, facilitate exports of Special Chemicals, Organisms, Materials, Equipment and Technologies (SCOMET) items, and extend the validity of certain export authorisations.
1. Extension of SCOMET Authorisation-Based Facilitation
The existing authorisation-based facilitation available to eligible exporters has been extended to holders of valid 4-Star and 5-Star Export House Status Certificates.
Accordingly, the following changes have been introduced:
| Sr. No. | Existing requirement | Revised requirement |
|---|---|---|
| 1. | Submission of a copy of the AEO certificate (where applicable) under the Stock and Sale provisions. | A copy of the AEO certificate or a valid 4-Star/5-Star Status Holder Certificate may be furnished. |
| 2. | AEO certification along with ICP compliance was mandatory for re-export to vendors/OEMs under the relevant GAER provision. | AEO certification or a valid 4-Star/5-Star Status Holder Certificate, along with ICP compliance, is now acceptable. |
| 3. | AEO certification along with ICP compliance was required for re-export to vendors/OEMs under the corresponding GAER provision. | The requirement has been extended to include holders of valid 4-Star/5-Star Status Holder Certificates, subject to ICP compliance. |
| 4. | AEO Tier-2 certification of CISC was prescribed under the relevant GAEIS provision. | AEO Tier-2 certification of CISC or a valid 4-Star/5-Star Status Holder Certificate may be submitted. |
| 5. | AEO Tier-2 certification of CBIC was prescribed under the relevant GAEIS provision. | AEO Tier-2 certification of CBIC or a valid 4-Star/5-Star Status Holder Certificate may be submitted. |
2. Extension of Validity of General Authorisation for Export after Repair in India (GAER)
The validity period of the General Authorisation for Export after Repair in India (GAER) has been increased from one year to three years from the date of issuance of the authorisation.
The extended validity applies to:
- GAER issued for the export of imported items after repair in India.
- GAER issued for the export of imported SCOMET items after repair in India.
However, exporters must continue to comply with the applicable post-shipment reporting requirements. Reports are required to be submitted within 30 days from the end of each quarter.
3. Effective Date and Applicability
The amendments introduced through this Public Notice take effect immediately.
The revised facilitation provisions extend the existing SCOMET authorisation-based benefits under the Stock and Sale, General Authorisation for Export after Repair in India (GAER), General Authorisation for Export of Telecommunication-related items (GAET), and General Authorisation for Export of Information Security Items (GAEIS) procedures to eligible exporters holding valid 4-Star or 5-Star Status Holder Certificates, subject to fulfilment of the prescribed conditions.
Further, the extension of GAER validity from one year to three years is intended to simplify export procedures and facilitate exports of SCOMET items following repair in India, while retaining the applicable reporting and compliance obligations.
